If you wish to challenge the Asbestos Fund’s decision, you can file an appeal within 3 months from the date you received the decision.
To do this, you must submit your case to the competent Labour Court.
How to File an Appeal
You have two options to submit your appeal:
- By written request: submit it in person or send it by registered mail to the clerk of the Labour Court.
- By summons: this procedure is subject to a fee, which the Asbestos Fund will not cover.
The letter informing you of the decision contains a list of competent Labour Courts and further information on how to proceed with your appeal.
Costs and Coverage

Court fees are fully covered by the Asbestos Fund, unless the appeal is deemed abusive or vexatious.

You are responsible for paying any fees or charges for your doctor or lawyer, if you choose to hire one.
Important to Know
The appeal procedure against an Asbestos Fund decision is different from the one applied by Fedris.
In accordance with Article 125 of the Program Law of 27 December 2006, compensation paid by the Asbestos Fund excludes any legal action against a third party.
This rule is designed to ensure fast, lump-sum compensation, but it limits the possibility of judicial recourse.
