• The Asbestos Fund is managed by Fedris, the Federal Agency for Occupational Risks (hereinafter referred to as Fedris). Fedris is responsible, under the laws of July 3, 1967, on the compensation for damages resulting from work accidents, accidents on the way to work, and occupational diseases in the public sector, and the law of April 10, 1971, on work accidents, the coordinated laws of June 3, 1970, related to the prevention of occupational diseases and the compensation of damages resulting from them, for actively contributing to the protection and promotion of workers' health in the workplace, in terms of prevention, correct compensation for damages of occupational origin, reintegration into the workforce, as well as monitoring the proper implementation of the law concerning occupational risks, and for paying compensation to asbestos victims in accordance with Title IV, Chapter VI, of the program law (I) of December 27, 2006.

    Fedris, located at Avenue de l'Astronomie, 1, 1210 Brussels, company number 0206.734.318, acts as the data controller for the data processed in the course of its duties.

  • In this context, Fedris processes all personal data necessary to carry out the following main tasks and purposes:

    • Responding to your request and processing your file;

    • Establishing and paying the social benefits you are entitled to under Fedris' responsibility;

    • Monitoring insurance companies and employers in terms of occupational risks;

    • Managing litigation: disputes against Fedris' decisions, recovery of overpayments, recovery of benefits paid from third parties responsible;

    • Providing information and support (whether proactive or not) to individuals, to allow them to fully assert their rights and promote their physical, mental, and social well-being;

    • Managing your interactions with our services, regardless of the channel used;

    • Proper management and improvement of our services and the social security and public health system, and combating fraud, through audits, investigations, scientific studies, statistical and historical analysis, as well as measures to secure and protect data, assets, and individuals;

    • Complying with our legal obligations, including with the Social Security Crossroads Bank.

  • As part of the management of the institution and the prevention of occupational risks, the data processed by Fedris is based on Articles 6.1. a), c), d), e), f), 9.2 b), c), g), h), i), and j), as well as Article 87 of the European Regulation. In doing so, we rely on the following specific legislations and their implementing decrees:

    • Law of July 3, 1967, on the compensation for damages resulting from work accidents, accidents on the way to work, and occupational diseases in the public sector;

    • Law of April 10, 1971, on work accidents;

    • Coordinated laws of June 3, 1970, related to the prevention of occupational diseases and the compensation for damages resulting from them;

    • Law of January 15, 1990, establishing the Social Security Crossroads Bank, Royal Decree of February 4, 1997, and other implementing decrees;

    • Law of August 8, 1983, organizing a National Register of Natural Persons, and the Royal Decree of December 5, 1986, on its use in health insurance-disability;

    • Law of August 21, 2008, on the eHealth platform;

    • Law of April 11, 1995, establishing the Charter of the Social Insured;

    • Law of August 22, 2002, on patient rights;

    • Program Law (I) of December 27, 2006.

  • Depending on the services you use or the information you provide to us, Fedris may process the following personal data:

    • Identification data (names, address, phone number, etc.);

    • Financial data;

    • Physical data (height, weight, etc.);

    • Psychological data (personality, character, etc.);

    • Education and training;

    • Image recordings (via surveillance cameras in our premises);

    • Personal characteristics (age, sex, marital status);

    • Lifestyle habits;

    • Household composition;

    • Relevant organizations involved in processing your request or paying your compensation (mutual insurance companies, unions);

    • Housing characteristics;

    • Profession and employment.

    Depending on the services you use or the information you provide to us, Fedris may also process the following sensitive data:

    • Data from the National Register: national registration number and identification data (name, surname, place and date of birth, gender, nationality, primary residence, place and date of death, marital status, household composition, legal cohabitation, type of registration);

    • Data from the Social Security Crossroads Bank;

    • Health-related data: physical health, mental health, risk situations and behaviors;

    • Judicial data: judicial measures (seizures).

     

  • The data that concerns you mainly comes from:

    • Yourself, your legal representative, or anyone authorized by you;

    • Healthcare providers (hospitals, doctors, etc.) you have consulted;

    • The Social Security Crossroads Bank and other public administrations involved in social security;

    • Insurance companies operating in the field of work accidents;

    • External prevention services;

    • Judicial institutions and appointed parties.

  • All data is processed by authorized personnel who are legally or contractually bound by confidentiality obligations. Additionally, technical and organizational security measures are implemented to ensure the confidentiality, integrity, and availability of your data.

  • Your personal data can be communicated to:

    • You and/or your representatives (including provisional administrator, lawyer, mediator, medical advisor, etc.) holding a mandate or judicially designated as such, directly or through a healthcare professional;

    • Social security bodies, mainly: the National Inter-mutualist College, the Social Security Crossroads Bank, ONEM, mutual insurance companies, the Auxiliary Health Insurance Fund, the Mutuality Control Office, and INAMI, within the scope of their legal missions;

    • Our company auditor, internal and external auditors, all bound by confidentiality obligations;

    • Our lawyers and the judiciary in case of litigation;

    • Any institution granting you a benefit if you have a privileged status;

    • bpost for mailing our correspondence;

    • A duly authorized third party (law, contract, consent);

    • Your creditors in the context of enforcement proceedings.

  • Fedris primarily works with the following subcontractors:

    • SMALS, Avenue Fonsny 20, 1060 Saint-Gilles, our IT provider;

    • BNP Fortis Paribas and bPost, our payment agencies;

    • The collaborating doctors of Fedris.

    On a less frequent basis, Fedris may also use other subcontractors in the execution of its legal obligations and public duties.

  • Your data may be transferred abroad if necessary:

    • To safeguard your vital interest;

    • For the execution of an international agreement to which Belgium is a party;

    • For the conclusion or execution of a contract with a third party in your interest.
      Or if you have unequivocally consented to this, or upon your request.

  • The data in your file may be retained for up to 10 years after your death, or up to 10 years after the end of the rights or death of your potential beneficiaries.

  • Under the legislation, you have the right to confirm whether your data is being processed by Fedris and the right to access it. To do so, you can send a written, dated, and signed request to our Data Protection Officer, attaching a front and back copy of your identity card (see contact details above).

    As long as your rights do not conflict with the legal obligations Fedris is subject to, you also have the right to:

    • Request correction of any inaccurate or incomplete data;

    • Request the deletion of any data;

    • Object to the processing of certain data;

    • The right to be forgotten (right to erasure);

    • Limit the processing of your data;

    • Not to be subject to automated decisions, including profiling (see below).

  • If the processing of your data is based on your consent, you have the right to withdraw your consent at any time and without justification.

    However, Fedris is legally required to manage personal data in the course of fulfilling its legal obligations.

  • You are subject to an automated decision in the following case: calculation of the base salary to determine the amount of replacement income granted.
